Mr. N. Goodwin outlined the events leading to the charge which Mr. McNab agreed with. These were he accepted the ride on Valdarah believing he could make the carded weight. The scales he used indicated that he would be OK. This however was proven not to be the case on race day. As the charge was admitted it was deemed proved.

Facts:
Jockey M. McNab admitted a breach of rule 330 (3) (c) in that he failed to make the weight for Valdorah in Race 6. Rule 330 (3) (c) reads: ‘A rider shall not fail to ride a horse at the weight at which it is handicapped to carry’.
Submissions for Penalty:
Mr. Goodwin outlined the previous three breaches of the rule and the penalties imposed. They were 09/10/2013 $100, 13/12/2013 $200 and 30/12/2013 $450.00.
Mr. McNab agreed with Mr. Goodwin's comments.
Mr. Goodwin submitted that Mr. McNab's record was not good and that he struggles with his weight. He had recently returned to race riding from injury. He viewed the breach as serious because of the frequency it seems to be occurring at. Mr. Goodwin did indicate he considered asking for a period of suspension but after discussing this breach with Mr. McNab he asked for a monetary penalty in the vicinity of $500 to be imposed.
Mr. McNab, in his submission, did agree that as a jockey who has been riding for a number of years he has a responsibility to ride at the carded weight.
In this particular breach he had recently returned to race riding after injury and believed he had his weight under control. He asked for a fine rather than a suspension because any enforced layoff makes it difficult for him to reduce his weight, as was proven on this particular occasion.
Reasons for Penalty:
In coming to my decision to impose a monetary penalty, I did consider a period of suspension for this Mr. McNab's fourth breach in 4 months. However, on hearing from Mr. McNab of his difficulty in dropping to a riding weight after an enforced layoff I was of the opinion that on this particular charge a period of suspension was not warranted.
It was pointed out to Mr. McNab in no uncertain terms that further breaches of this rule could, in the Chairman's opinion, only be handled by a term of suspension. He was a senior rider and with that comes responsibilities.
His admission of the breach to some degree was cancelled out by the three previous breaches over the last 4 months.
