The protest was dismissed and the Judge's placing’s shall stand.

The Committee authorised the payment of stakes and dividends in accordance with its decision.


 

Facts:

Following the running of race 4, Shaw Wire Ropes 1400, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Bayliss, alleged that EVER LOYAL or its rider placed 2nd by the Judge interfered with the chances of his mount BELLE DU NORD placed 3rd by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placing were as follows:

1st - No. 3 AGE OF FIRE
2nd - No. 2 EVER LOYAL
3rd - No. 5 BELLE DU NORD
4th - No. 1 EMBELLISH

The official margin between 2nd and 3rd was ¾ of a length.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

Mr Bayliss said that his mount was going to run nicely to the line. He said that EVER LOYAL kept changing ground and forced his horse to change its running line. He said BELLE DU NORD started 2 horse widths of the fence at the top of the straight and ended up 10 horse widths at the finish.

Mrs Browne said that EVER LOYAL was “leaning” out in the home straight and hampered BELLE DU NORD. She said that Mr Bayliss was unable to pull the stick on BELLE DU NORD and added that her horse needed hard riding.

Mr Waddell said that there was absolutely no way that BELLE DU NORD would have beaten EVER LOYAL. He said that while his mount did shift out in the final straight no contact occurred and EVER LOYAL was comfortably holding BELLE DU NORD at the finish.

Mr Pike said that BELLE DU NORD had 250 metres to make up ground on EVER LOYAL and was unable to do so. He said the interference was minimal.

Mr Oatham said that it was clear on the film that EVER LOYAL did shift out on 3 occasions over the final 250 metres and in doing so inconvenienced BELLE DU NORD. He said that the Stewards would struggle to accept that had such interference not occurred BELLE DU NORD would have beaten EVER LOYAL.

Reasons for Decision:

The Committee carefully considered all the submissions presented and reviewed the video footage. We observed that at the 200 metres EVER LOYAL shifted out into the line of BELLE DU NORD which resulted in that runner moving off its heels when briefly inconvenienced. At that point EVER LOYAL was approximately 1½ lengths in front of BELLE DU NORD. We identified that at the 100 metres EVER LOYAL was 1 length in front of BELLE DU NORD and EVER LOYAL gradually shifted out over the concluding stages of the race. Taking into account the degree of interference which in our opinion was low level and the ¾ of a length margin between the 2 horses at the finish the Committee was not satisfied that had such interference not occurred BELLE DU NORD would have beaten EVER LOYAL.
