As the breach was admitted we find the charge proved.
Penalty:
After taking all the above into account, we impose a 4 day suspension. Accordingly, and under the provisions of rule 1106, this suspension on Mr Forbes from riding in races, is to start after racing on 8 December and conclude after racing on 14 December 2011 (4 days).

Facts:
Following race 4, an information was filed pursuant to rule 638 (1) (d). The informant, Mr Coles, alleged that Mr A Forbes permitted his mount ZANKURO to shift inwards, crowding the running of MARADONA (J Wadell), which was then checked near the 900 metres.
Submissions for Decision:
Mr Williamson demonstrated the video films which showed ZANKURO racing on the outside of the field nearing the 800 metres. On his inside, and approximately 1/2 length behind, was MARADONA (J Waddell). Mr Williamson pointed out Mr Forbes allowing his mount to gradually shift in, and in doing, so tighten MARADONA which had to be checked. The films clearly showed that Mr Forbes was not the required distance clear of MARADONA when moving in.
Mr G Forbes conceded that interference had taken place, but submitted to the committee that the interference was at the low end of the scale.

Mr Coles said that Mr Forbes had only incurred one charge in the last 12 months, which was an excellent record. He said that in this case, the inward movement went on for some time and Mr Waddell was placed in an awkward position. He submitted that Mr Forbes' carelessness was in the low to mid range.
Mr A Forbes said that he had commitments up to and including 8 December.

The committee carefully considered all submissions and evidence. This was more a case of inexperience rather than negligence. Clearly Mr Forbes was not the required distance clear when moving in, which was an error of judgement on his part. Mitigating factors are his admission of the breach and his good record of one suspension since he started riding.
