Facts:
Following the running of race 10 the STALLIONS AUSTRALASIA HANDICAP TROT an information was lodged by Stipendiary Steward Mr S Renault by way of a protest alleging Interference 75 metres when RED HOT ROCKET (G Smith) shifted outwards onto TRICK STAR
Rule 869A (2) provides as follows:
(2) When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with.

Submissions for Decision:
Mr Renault used the race video to identify RED HOT ROCKET (G Smith) racing 3 wide into the home straight with TRICK STAR (S Ottley) trailing behind. He then pointed to Ms Ottley angling into the gap between Mr Smith and TIME FOR DIAMONDS which was to Ms Ottleys outside. Mr Renault demonstrated on the video that the gap Ms Ottley was driving into was a least 2 cart widths wide. He then played the video on to show just after the 100 metres Mr Smith shifting outwards and closing the gap to the extent that Ms Ottley was denied a run.
Mr Renault then asked Ms Ottley to give an account of the incident. She said that her horse was finishing very strongly and definitely would have finished a lot closer than it did had she had a clear run. Mr Renault asked Ms Ottley where the pressure had come from and she said initially she thought from both sides but after viewing the video she observed that most of the pressure was from the inside.
Mr Smith used the race video and explained that his horse had shifted outwards as a result of a bump from SUNNY GLENIS which was racing on his inside. He admitted the interference was mostly from his quarter but there was some movement inwards onto Ms Ottley from TIME FOR DIAMONDS.
Reasons for Decision:
The Committee carefully considered the submissions from all parties. The head on race video was very clear in establishing the interference was from Mr Smith. We considered that any movement from TIME FOR DIAMONDS was minimal at best and the bump Mr Smith alluded to was only a slight reaction to SUNNY GLENIS’S minor shift at the 150 metres. We concluded TRICK STAR was finishing strong enough to convince us he would have finished in front of RED HOT ROCKET had he received clear running.
