In these circumstances, the protest is dismissed. Placings are as the horses crossed the line. Stakes and dividends are to be paid accordingly.

Facts:

At the conclusion of Race 5, an information instigating a protest by horse number 13 against horse number 6, was lodged by Mr McIntyre, under rule 869(8)(a)(b), alleging interference near the 1400 metres when HUDSON SULLY broke, resulting in NORA THE PIANIST having to check, and breaking as a result.

Judges placings were:

Submissions for Decision:

Mr McIntyre showed this committee a video of the horses racing at approximately the 1400 metres mark. He pointed out that HUDSON SULLY, which was racing 3 back on the markers, broke momentarily with the trailing drivers taking evasive action and NORA THE PIANIST, which was towards the rear of the field, breaking briefly.

In giving evidence, Mr May stated that he saw Mr Williamson gallop, and thought that HUDSON SULLY may have kept galloping, but the horse did not do so. He believed that his horse might have over-reacted when he pulled it wider on the track to avoid the horses, which were coming back as a consequence of HUDSON SULLY breaking. He further stated that he never considered he was a place chance, as his horse was “never going any good”. He added that his horse should never have galloped.

Mr Williamson said that he had only broken briefly, and that he came back down still trailing the horse that he had been trailing. He said that Mr May’s horse had only broken for a few strides and had not lost its position in the field.

Reasons for Decision:

We are satisfied that NORA THE PIANIST did break as a consequence of HUDSON SULLY breaking briefly. The horse has thus suffered interference. However, whilst NORA THE PIANIST has broken, it was only for a few strides and the horse has settled back into the position that it was in prior to receiving the interference. Mr May was adamant that this did not affect his chances of finishing in a stakes-bearing position. We also observe that NORA THE PIANIST was pulled out wide in the straight, but failed to run on strongly to the line and finished towards the rear of the field. We are not satisfied that the chances or progress of NORA THE PIANIST were affected.
