Facts:
Prior to the running of Race 8 (ROBERTSON PRESTIGE 1400), Information A12291 was filed with the Judicial Committee. It alleged a breach of rule 330(3)(c) and stated that Mr D Turner “failed to make the required weight for THAT’S FUNNY being 1Kg overweight”.
Rule 330(3)(c) states:
“A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Turner confirmed that he understood the rule and admitted the breach.
Mr Goodwin said that following Race 6, Mr Turner had informed the stipendiary stewards that he would be unable to make the weight for his ride in Race 8 as he was 1 kgs over. As a result, they had permitted him to ride overweight as there was no suitable replacement available.
Mr Turner had nothing to say.
Submissions for Penalty:
As this rule was listed on the Minor Infringement Schedule, Mr Goodwin identified two previous breaches within the previous 120 days reset period; Riverton RC on 20 April - $300 fine and Wanganui JC on 4 July - $200 fine. For the current breach, the RIU sought a fine that was in excess of $300.
In response to a question from the Committee, Mr Turner said he would try and prevent any further breaches of this rule by trying to control his weight better. He had no further submissions to make.
Reasons for Penalty:
The Committee considered all of the submissions placed before it. First and second breaches within a 120 day timeframe are dealt with by way of a Minor Infringement. This has been referred to the JCA as it is the third breach within the reset period. We have had regard to Mr Turner’s record under the rule and it appears to us that he clearly has an issue and must seek to get his weight under control, or simply not accept rides at weights that can not be accommodated. Further breaches within a short period of time are likely to attract more significant penalties, and Mr Turner understands this. On this occasion the punters and connections were disadvantaged as he was required to ride 1kgs over the horse’s carded weight, due to no suitable replacement being available.
