The Protest is not contested and is therefore upheld. The Committee orders that LEMOND be disqualified from the Race.

The amended placings are now : first(1) TEMPORALE

                                                   second(5) THE ALMIGHTY JOHNSON

                                                   third(14) PRIME POWER

                                                   fourth(4) YOUGUNNAKISSMEORNOT

                                                   fifth(10) BLACKGUARD'S CORNER.

The Committee orders that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the MAJESTIC HORSEFLOATS GREENLANE CUP HANDICAP TROT an Information instigating a Protest was lodged by Chief Stipendiary Steward Mr N Ydgren against the 3rd placing of LEMOND on the grounds that it galloped in excess of 150 metres after breaking approaching the first turn.

Rule 870(3) provides: that any horse that breaks during the running shall promptly return to its correct gait.

The Breaking Horses Regulations provide: that any horse which breaks during the running of a Race and continues in a break in excess of 150 metres shall be in breach of Rule 870(3).

Mr R Paynter the Trainer of LEMOND advised the Committee that he did not contest the Protest and he signed the Information accordingly. Mr Paynter also did not wish to be present at the Hearing.

Mr Ydgren demonstrated the incident by use of the race films and showed where LEMOND broke from its gait approaching the first bend and he estimated that it continued in a break for approximately 250 metres.

Mr Ydgren submitted that LEMOND  was in breach of Rule 870(3) and should be disqualified from the Race.
