Decision:

As the breach was admitted we find the charge proved.

Penalty:

Mr Stables was suspended from driving from after racing on the 20th November until after racing on the 17th December.  On the assumption that Mr Stables normally drives once a week this period of suspension equates to 4 driving days.

Charge:

Failing to start from correct barrier position

Facts:

An information was filed  alleging that Mr Stables driving Johny Wilkinson in race 2 failed to start the horse from its correct barrier position at the extreme outside for unruly horses. 

Mr Stables appeared for the hearing and admitted the breach endorsing the information accordingly.

Mr Taumanu referred the hearing to films of the start of the race and identified Johny Wilkinson.  Because of his unruly status he should have started from the extreme outside however despite intructions from the starter began from about barrier 5 at the front of the field.

The horse had become fractious at the start and broke moving towards the running line dislodging  Mr Downey on Touche Express and causing that horse to lose all chance.

If the horse had been started from the correct position the impact of its behaviour on the other runners may have lessened.

Mr Stables acknowledged had had received instructions from the starter about his starting position.

Submissions for Penalty:

Mr Taumanu told the committee the suggested starting point for this breach was $400 but the consequential effects were quite important as another horse had been put out of the race.  He contended the breach was towards the upper end of the scale particularly after he had failed to heed the directions of the starter.  Mr Stables had only recently started driving and had a total of 4 lifetime drives.  Because of Mr Stable's situation and the seriousness of the breach he suggested the committee may consider a period of suspension more appropriate.

Mr Stables explained that he was only training his own horses and not receiving renumeration from this activity.  Having only recently started driving and because of his financial situation he asked the committee consider a  period of suspension.  He confirmed he had no driving commitments.

Reasons for Penalty:

The committee took particular notice of the effect of Mr Stable's disregard of the starter's instructions on other runners in the race, one of which was effectively eliminated from taking any part.  The breach was at the upper end of the scale and was deserving of a significant deterrent penalty.

Balanced against that however was Mr Stables relative inexperience, his frank admission of the breach and his financial situation.
