Decision:

Based on all the evidence the Committee was satisfied that, despite the gates opening early, no runner was prevented from taking an effective part in the race. Mr Hannam was the only rider to express concern that he was slightly slow away; citing the fact that he was not ready at the time the gates opened. Rule 632 (1) excludes those horses that finish in the first three placings and JUST YOU finished in 3rd placing. Of the remaining runners all riders made it clear to the Stipendiary Stewards that their chances had not been affected.

Accordingly all horses were declared runners.

Facts:

Following the running of Race 5 (Wanganui Steelformers 1200) an information was lodged with the Judicial Committee requesting a ruling in relation to Rule 632 into the start.

Rule 632(1) reads: If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Mr Goodwin played the head and side on videos of the start. He explained that IRONBARK (W Pinn) charged the gates prior to the start being effected forcing open all the gates.

Submissions for Decision:

Mr Clement said the last horse entered the gates, he had the red light, and then suddenly the gates all opened. He had not had a chance to call “watch the gates” and he did not activate the start.

Mr Goodwin told the Committee that he had questioned all of the riders immediately after the race and all, with the exception of Mr Hannam (JUST YOU), had said they received a fair start.

The Committee heard from Mr Hannam who explained that his horse was playing up at the start and reared as the gates opened. The side-on view showed that he lost approximately a length in ground as a result.

Reasons for Decision:

The Judicial Committee considered all submissions. We found:

All horses were loaded into the gates without incident.

IRONBARK charged the gates triggering all the gates to open simultaneously.

Mr Clement (Official Starter) did not get the opportunity to call or to activate the gates.

All horses, except for Mr Hannam’s horse (JUST YOU) jumped away in line.

Mr Hannam’s horse lost approximately 1 length when it reared as the gates opened, but went on to be placed 3rd by the Judge.

Mr Clement considered calling a false start however it was his opinion that no runner had being disadvantaged by the gates opening early.
