Facts:
Mr Butt was charged with a breach of r 869 (3) (b), in that he allegedly caused interference to ZONED SCARLET when shifting MDINA inwards when not sufficiently clear, in race 6. He did not admit the charge.
Submissions for Decision:
Mr Renault, with the use of the videos, stated ZONED SCARLETT (B Williamson) was leading into the first bend. MDINA (C Butt) which was wider out was shifting inwards and searching for the lead. He alleged that Mr Butt shifted across in front of ZONED SCARLETT, but was too close and in doing so crowded that horse, which broke.
Mr Williamson stated that his horse was racing keenly under a hold. He stated that as MDINA crossed over to the lead his horse’s outside foot struck the inside sulky wheel of MDINA, causing his horse to break. He said he never heard anything and assumed that’s what caused his horse to break.
Mr Butt stated he always felt he was clear of ZONED SCARLETT when he crossed over. He never heard or felt any contact being made. He felt he was ahead of ZONED SCARLETT and that that horse had struck his wheel from behind.
Reasons for Decision:
The onus is always on the horseman who is shifting inwards, or outwards, to ensure they are clear of any runner(s). We are not satisfied Mr Butt was sufficiently clear of ZONED SCARLETT when he shifted MDINA across to the lead.

Mr Renault stated Mr Butt had an excellent record under the rule. He had 39 drives last season and 5 this season to date. He sought a suspension of 10 drives or a $500 fine.
Mr Butt stated he had recently shifted his training base to Dunedin but intended to race horses in the Canterbury area prior to Cup week. Mr Butt has declared drives at Ashburton tomorrow.
