Following the running of Race 2, the Harcourts Otaki Highweight, Stipendiary Steward, Mr N Goodwin presented an Information charging Mr Barry Donoghue, Licensed Rider, with excessive use of the whip, a breach of Rule 638(3)(b(ii).
Mr Donoghue admitted the charge.
The race film disclosed that Mr Donoghue struck his mount WHOLETTHEFOXOUT 11 times with the whip prior to reaching the 100 metre point.

Mr Goodwin contended that a suspension was necessary because of the excessive number of strikes, referring to the Revised Whip Guidelines which recommend a 6 day suspension if the number of strikes is 10 or more.
Mr Donoghue accepted that he ought to know the Rule as it applied to flat races and apologised for his error.
