As Mr Rusof has admitted the breach with find the charged proved.

Accordingly we fine Mr Rusof the sum of $200.
Facts:
An Information was lodged by Mr J Oatham alleging a breach of Rule 330(3) (c) in that jockey, S Rusof was unable to make the contracted weight for OUR ABBADEAN.
Rule 330(3)(c) states:
A Rider shall not:
(c) fail to ride a horse at the weight at which it is handicapped to carry
Mr Rusof said he understood the nature of the charge and confirmed that he admitted breach.
Mr Oatham said that early in the day Mr Richards, the co-trainer of OUR ABBADEAN, advised the Stewards that they would be replacing Mr Rusof on the horse because he was ½ kilo over the handicapped weight of 53kgs. The stable was not prepared to put Mr Rusof on overweight and instead replaced him with Ms D Johnson.
Mr Rusof said he weighed in today at 53.7kg and tried to lose a ½ kilo this morning but had no luck. He has recently been riding in Singapore where he did not have any weight issues.
Submissions for Penalty:
Mr Oatham said Mr Rusof has only recently returned to New Zealand after riding here as an apprentice. He has had only a handful of rides and his record is clear.
Mr Oatham said it was unusual for a rider to face a charge when only ½ kilogram over but the Stewards decided to charge Mr Rusof because it was a Group 2 race and the expectation from Te Akau was that he would ride at the correct weight. The stable was fortunate that another lightweight rider, of Ms Johnson’s experience, was available.
Mr Oatham submitted that a monetary penalty in the range of $200 - $300 would be appropriate.
Reasons for Penalty:
Breaches of Rule 303(3)(c) are normally covered by the minor infringement scheme unless there are aggravating factors. A first offence of failing to make the contracted weight attracts a $100 penalty and a second offence $200 (Penalty Guide for Judicial Committees).
With this being his first offence Mr Rusof would normally be fined the sum of $100.
The Committee has had regard to the fact that this breach occurred in a Group 2 race and is of the opinion that the fine should therefore be higher. It is important that riders meet their obligations when accepting to ride at contracted weights.
