Facts:
Following the running of Race 1 (BISHOPDALE/BUSHINN TABS AND TAVERN HAREWOOD (AMATEUR DRIVERS) MOBILE PACE 2000m), Amateur Horseman D Reardon was charged with a breach of Rule 869(2)(a). The Information stated: "You used your whip excessively over the concluding stages."
Rule 869(2) reads: "No horseman shall during any race:- (a) use his whip in an unnecessary, excessive or improper manner."
Mr Reardon confirmed that he understood the rule and that he admitted the breach.
Using the available side-on film, Chief Harness Stipendiary Steward Mr Ydgren identified Mr Reardon (PATRICK BEE) racing in the three-wide line as the runners ran for home. As he was racing to the outside of the field, Mr Ydgren identified that Mr Reardon had used his whip 19 times free of the rein without considerable pause.
Mr Reardon told the committee that it was clear that he had to change his whip action. While it may have been a continuation of his whip use, he explained that a number of the strikes were against the sulky shafts, not on the horse. However, Mr Reardon accepted that such an action did not look good to those who were watching the race on Trackside.
Submissions for Penalty:
Mr Ydgren submitted that Mr Reardon had previously held a Graduated Horseman's Licence last season with 16 drives. This season he had committed to drive with Advanced Amateur status. He noted this was Mr Reardon's first breach under this rule and that he should also be given credit for his admission of the breach. Mr Ydgren identified that the JCA Penalty Guidelines noted a two day suspension or a $500 fine as the starting point for a breach of this rule. Given the sporadic nature of drives available to Advanced Amateur drivers, he submitted a fine in the vicinity of $300 as appropriate.
Mr Reardon reconfirmed his commitment to work on his whip action, and had nothing further to add.

The committee considered all of the submissions placed before it. It is clear from the side-on film that Mr Reardon had used his whip in his right hand for approximately 18-19 strikes with limited respite in the final straight. The JCA Penalty Guidelines identify a starting point of a two day suspension or a $500 fine for a first breach. The committee determined that a fine was appropriate on this occasion, due to the limited driving opportunities available to Mr Reardon and adopted the starting point of $500. In mitigation the committee considered Mr Reardon's early admission of the breach and his excellent record under this rule. The committee believed these aspects should afford Mr Reardon a discount in the quantum of $200.
