Ms Hercock admitted the breach, therefore the charge was deemed proved.

Penalty:

Accordingly Ms Hercock is fined the sum of $600.

Facts:

Following Race 4, Mr Goodwin lodged an Information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that K Hercock used her whip excessively prior to the 100 metres.

At the outset of the hearing, Ms Hercock confirmed she understood the Rule and admitted the breach.

Mr Oatham used the videos to identify Ms Hercock racing back in the field on SANIBEL. She shifted to the inside and commenced to use her whip 8 times prior to the 100m.

Ms Hercock agreed that the number of strikes was accurate.

Submissions for Penalty:

Mr Goodwin presented Ms Hercock’s record which showed one prior breach of the Whip Rule within the last 6 month period. This was in January 2021, and incurred a monetary penalty of $350. Mr Goodwin submitted that the Committee could consider an uplift due to the fact that SANIBEL won the race today.

Ms Hercock said she is trying really hard to ride within the Guidelines, and has even changed the way she holds the stick.

Reasons for Penalty:

NZTR revised the Whip Penalty Guidelines in October 2019. When the number of strikes is under 10 the Penalty Guidelines provide a starting point of $500 for a second breach. Ms Hercock has had 71 rides since December and the Stewards said she is making an impact after returning from a long break.

The Committee adopted a starting point of $500. After viewing the race through until the finish and noting that SANIBEL won the race by a ½ neck margin under a hard ride, it is appropriate that an uplift is applied on this occasion.
