As Mr Harris admitted the breach we found the charge proved.
Penalty:
The Committee took into account Mr Harris’ upcoming riding commitments and accordingly suspend his license from the close of racing on Wednesday October 10th up to and including racing on Thursday October 18th.
Facts:
Following the running of Race 3 (Dan D’Esposito Memorial), an Information was lodged by Mr J Oatham alleging that jockey Troy Harris (COPPER MINE) shifted out on the home straight turn when not clear of DEVINE LOVE.
Mr Oatham had Mr Goodwin explain the incident with the assistance of four different video angles.
Mr Goodwin showed Mr Harris racing in a position behind the leader coming around the home turn towards the straight entrance. He then angled out from behind Mr Allan’s mount just as runners to his outside were improving around him. As Mr Harris came out he dictated Mr Waddell’s mount wider which started a chain reaction affecting the mounts of Mr Turner, Mr Innes, Ms Sam Collett and Mr Tim Johnson. Mr Goodwin said while Mr Harris only moved out approximately one horse width his action resulted in several runners being dictated wider on the track.
While Mr Harris agreed that he had forced Mr Waddell and Mr Turner wider it was his opinion that Mr Innes was improving out wide “into nowhere” and he made the incident look worse for the two outside runners.

Mr Oatham presented Mr Harris’ riding record for breaches of the careless riding rule over the last 12 month period:

08/04/18 - Counties 6 days
25/04/18 - Avondale 6 days
He said Mr Harris had been struggling a little with his weigh in recent weeks and had not been taking a lot of rides. In the last 12 months he had had 214 rides prior to today.
Mr Oatham submitted that the level of carelessness was in the low to mid- range
Mr Harris advised of riding commitments only through until Taupo on Wednesday October 10th.
Reasons for Penalty:
In coming to a decision on penalty the Committee first considered the degree of carelessness. On rounding the bend for home Mr Harris angled out to improve his position from behind the leading horse. This outward movement was not large however it did have the effect of setting up a chain reaction to several runners on his outside hampering them as they were improving position.
We adopted a starting point of 7 days. Mitigating factors were Mr Harris’ admission of the breach and his record we deemed neutral.
Balancing up all factors we determined that an appropriate penalty was one of 6 riding days.
