Accordingly the protest is dismissed and the judge's placings shall stand. In conclusion we order the payment of stakes and dividends.

Facts:

Following the running of Race 10, an information Instigating a Protest was filed pursuant to Rule 642. The informant, Mr A Calder, alleged that MANGAROA MINI placed 2nd by the judge interfered with the chances of his mount EWENIGHT placed 3rd. The interference was alleged to have occurred in the final straight.

The judge's placing were as follows:

1st No. 8 KIJANI
2nd No. 12 MANGAROA MINI
3rd No. 6 EWENIGHT

The official margins were a short head between 1st and 2nd and 2 lengths between 2nd and 3rd.

Submissions for Decision:

Mr Calder submitted his protest was filed on the grounds that EWENIGHT didn't get clear running in the last 100 metres when it was making up substantial ground from a long way back. He said the winner KIJANI shifted in sharply resulting in his horse receiving severe contact. He then submitted that MANGAROA MINI who was racing on their inside has rolled out as a consequence and made contact with his horse. He believed his mount would have won the race because he hadn't asked his mount for anything when he received a check. He submitted that he was about to burst between KIJANI and MANGAROA MINI when he received severe contact and his mount did well to stand up. He said at that point the damage was done.

Mr Phillips submitted that he agreed with Mr Calder's interpretation of the incident. He believed that both horses contributed to the interference when his horse had a full head of steam up.

Mr Thomas submitted that KIJANI moved in and caused interference to both MANGAROA MINI and EWENIGHT. He said EWENIGHT had its chances extinguished by KIJANI moving into its rightful line. This resulted in MANAGAROA MINI receiving pressure from EWENIGHT who he believed forced his horse to shift out.

Mr Cameron submitted that he was in front and got a shove from behind. He said this occurred when KIJANI moved in onto EWENIGHT who in turn shunted MANGAROA MINI. He believed the pressure had come from KIJANI which caused his mount to be turned sideways and lose momentum.

Mr Williamson when asked for his assessment of the alleged interference submitted that the protest should be dismissed on the grounds that KIJANI forces the pressure onto EWENIGHT who in turn checked MANGAROA MINI.

Mr Calder in summing up submitted that at the 100 metre mark he was within a neck of hitting the front and hadn't gone for his horse. He stated both KIJANI and MANGAROA MINI were being ridden with vigour when he received the interference.

Reasons for Decision:

The committee carefully considered all evidence and submissions presented and reviewed the video films several times. We established that at approximately the 150 metres KIJANI shifts in under pressure approximately 2 horse widths, when being ridden strongly with the whip. This in turn forced EWENIGHT onto the hind quarters of MANGAROA MINI which then became unbalanced and turned sideways losing momentum. When MANGAROA MINI was turned sideways she impeded EWENIGHT which was checked at approximately the 100 metre mark.

In summing up we believe the head on film clearly shows that MANGAROA MINI was inconvenienced by the shift inward caused by KIJANI who in turn hampered EWENIGHT. We are of the view that the blame can't be placed on MANGAROA MINI for EWENIGHT receiving interference.

Therefore for these reasons we dismiss the protest.
