Following the running of Race 4, Waimate Veterinary Centre & CRT Farmlands Maiden, an information was filed by Stipendiary Steward, Mr M R Davidson, against Licensed Apprentice Jockey, Mr D Prastiyou, alleging a breach of Rule 638(1)(d) in that Mr Prastiyou “permitted his mount ALFIE’S BELLE, to shift inwards near the 1100 metres and in doing so caused FULLOVTRIX (T R Moseley) and BEST FELLA (A L Frye) to be crowded and checked”.
Mr Prastiyou was present at the hearing of the information and he indicated that he admitted the breach. He was assisted at the hearing by his employer, Licensed Public Trainer, Mr P S Richards.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Submissions for Decision:
Mr Davidson had Stipendiary Steward, Mr N M Ydgren, show the incident on video replays. Mr Ydgren pointed out ALFIE’S BELLE, ridden by Mr Prastiyou, which had drawn barrier 5 at the 1200 metres start, approximately 100 metres after the start. Racing on his inside was SWEET BUT NEAT (S Muniandy) and on the inside of that runner were FULLOVTRIX (T R Moseley) and BEST FELLA (A L Frye).
Mr Ydgren then pointed out Mr Prastiyou shift in and initially check Mr Muniandy and then continue to come across when insufficiently clear of the other two runners. Mr Prastiyou had looked to his inside but he had “cut it too fine” and had not afforded the other runners enough room, he said.
Mr Richards conceded that Mr Prastiyou had clearly inconvenienced the three runners inside him. He had come over too quickly and, in doing so, had “shaved” those runners. He had misjudged the distances but the other runners did not receive bad checks, Mr Richards said.
Mr Davidson agreed that it had been a miscalculation on Mr Prastiyou’s part – had he ridden up another half length before crossing he would have been clear. The breach was in the mid to low range. While there was no severe check to any other runner, there were three other runners inconvenienced, Mr Davidson submitted.
Submissions for Penalty:
Mr Davidson informed the Committee that Mr Prastiyou incurred a suspension of 2 days for careless riding in October 2012. He has been riding since September 2012 and is now starting to pick up rides. He is one of the more promising apprentice riders in the Otago area. Mr Prastiyou told the Committee that he has had 110 raceday rides. Mr Davidson submitted that his riding record was “reasonable”. He was always cooperative with Stewards and had a good attitude. He had admitted the breach at an early stage. He submitted that an appropriate penalty was a suspension of 2 to 3 South Island days. The breach was in the low to mid range, Mr Davidson submitted.
On Mr Prastiyou’s behalf, Mr Richards sought a deferment for a period of 7 days to enable Mr Prastiyou to ride at the Ashburton meeting on 5 July next where he had “a couple of good rides”.
Reasons for Penalty:
In determining penalty, the Committee had regard to Mr Prastiyou’s frank admission of the breach and his race riding record, which Mr Davidson described as “reasonable”. The Committee has assessed that, although Mr Prastiyou had a previous breach of the Rule in October 2012, he will have had approximately 100 rides since that time. We accepted that Mr Prastiyou is a promising rider and needs to be encouraged. We further accepted that the breach was no worse than low to mid range.
Taking all of those matters into account, the Committee believed that the appropriate penalty is a 2-days suspension. We have arrived at this by taking a starting point of 4 days, which takes into account the limited opportunities available to South Island apprentices at this time of year. We have allowed a discount of 2 days from that starting point for Mr Prastiyou’s admission of the breach and his riding record which, we believe, is a good one.
The Committee granted Mr Prastiyou’s application for a deferment until after the Ashburton meeting on Friday, 5 July 2013.
