The committee found that the charge of careless riding preferred against Miss V Johnston had been proved.

Penalty:

Miss Johnston’s Jockey's License was suspended from the conclusion of racing on 3 May 2013 up to and including all racing on 8 May 2013 (4 days).

The 4 days being;

4 May 2013 Waikato
6 May 2013 Matamata
7 May 2013 Wanganui
8 May 2013 Avondale

The penalty did not include any South Island meetings as Miss Johnston confirmed that she did not intend riding at any upcoming S.I. meetings.

Careless Riding

Facts:

Following the running of Race 5 (Cavallo Agistment Maiden) an Information No. A3138 was filed by stipendiary steward Mr N Goodwin under Rule 638(1)(d). The information stated that V Johnston “Just Like No Other” allowed her mount to shift inwards near the 1400m tightening Precede (M Dee), Savabelle (J Riddell) and Last To Dance (J Parkes).

Miss Johnston signed the information that she did not admit the breach and confirmed that she understood the rule and the charge preferred against her.

Rule 638(1)(d) states;

A rider shall not ride a horse in a manner which the judicial committee considers to be careless.

Submissions for Decision:

Mr Goodwin called Mr Riddell and Mr Dee as witnesses.

Mr Riddell said that Precede came in and pressured his mount when only 1 length clear and that he had to check his mount to avoid the heels of Precede. He said that he could not be sure who was outside Precede at the time as he was trying to save the riders back on his inside. Miss Johnston did not have any questions for Mr Riddell.

Mr Dee said that he was racing inside Miss Johnston and that his mount was going keenly. He said that Miss Johnston came in on him and that he had to check. He said that she was not a full two lengths clear when she came in, was only about a half-length. Miss Johnston asked Mr Dee if his mount was hard to control, he answered yes. Under further questioning from Miss Johnston Mr Dee said that her mount was probably one and half lengths clear when it came in.

Mr Goodwin invited Mr Neal to show all videos of the incident with Mr Neal commenting that in the stewards' opinion Miss Johnston, in attempting to get closer to the running rail, had allowed her mount to shift in when barely a length clear of Precede, resulting in that runner being checked and taken in onto Savabelle who was also checked with Last To Dance also being affected in the incident. He added that Miss Johnston had come across on an acute angle when not clear and had not complied with the requirements. Miss Johnston did not have any questions of Mr Neal.

Miss Johnston for her part said that it was not a black and white case and that that was why she defended the charge. She said that in her opinion she was one and a half lengths clear when coming in and that Precede had contributed to the incident by over-racing and being erratic and that it had balked at the same time as she and her mount had shifted in. She added that she also attempted to come off Precede when it got tight. She said that in her opinion it was only competitive riding.

Mr Goodwin in summation said that Miss Johnston allowed her mount to shift in when only one length clear of the runner to her inside (Precede) and that in the stewards' view this was the cause of the interference that had occurred.

Reasons for Decision:

The committee having given due consideration to all of the evidence which included video clips, found that near the 1400m (Race 1600m) Miss Johnston allowed her mount “Just Like No Other” to shift in when not sufficiently clear of Precede (M Dee). As a consequence Precede was checked and taken in into the rightful line of running of Savabelle (J Riddell) who also had to be checked to avoid heels, also affected was Last To Dance (J Parkes) who was racing back and to the inside of Savabelle.

Submissions for Penalty:

Mr Goodwin said that Miss Johnston had a very good record; her only careless riding over the last 12 months was on 13 December 2012 when she was suspended for 3 riding days. He said that the stewards considered that the carelessness to be above mid-range and submitted that a 5 day suspension would be appropriate.

Miss Johnston said that considering her very good record she believed that a 5 day suspension was too much and that 3 days would be more appropriate. She asked that any suspension imposed start after racing on 3 May 2013.

Reasons for Penalty:

The committee categorised the careless riding to be above mid-range and under normal circumstances a minimum of 5 riding days suspension would have been imposed, however due to Miss Johnston’s very good record under the careless riding rule 638(1)(d) a suspension of 4 riding days was deemed to be an appropriate penalty.
