The breach is admitted and therefore the charge is proved.

Penalty:

This  Committee orders that Mr Coonee's Apprentice Rider's Licence is suspended from the conclusion of Racing today up to the conclusion of Racing at the Cromwell meeting on the 29th day of November 2020. We calculate that to be 5 National Riding days being Te Rapa, Otaki, Cromwell, Ellerslie and Cromwell.

Facts:

Following the running of the BROKERWEB 12OO an Information was lodged by Chief Stipendiary Steward Mr J Oatham against Apprentice Jockey Mr Y Coonee alleging that Mr Coonee as the Rider of MANRICO angled his horse inwards near the 800 metres mark when not clear of A PROPER LADY (Rider L Innes) which was checked and in turn it hampered LOOSE CANNON (Rider M McNab) and SAINTLY WAY (Rider S Weatherley.

Rule 638(1)(d) provides: A Rider shall not ride in a manner which the Judicial Committee considers to be careless.

Mr Coonee was present at the Hearing and he was assisted by Apprentice Jockey mentor Mr N Harris. Mr Coonee  confirmed his admission of the breach.

Stipendiary Steward Mr A Coles demonstrated the incident by use of the race films and he identified the horses involved in the incident. He showed where MANRICO was racing ahead of A PROPER LADY and it was one out from the  rail and Mr Coonee was looking to shift in. He said it went clear of A PROPER LADY but then Mr Coonee takes hold of it and shifted in and in doing so shifted into the line of A PROPER LADY which resulted in Mr Innes having to take hold of his horse and check across heels and in turn check LOOSE CANNON and SAINTLY WAY which were improving on his outer.

Mr Harris on behalf of Mr Coonee said that Mr Coles had properly described the incident but he also suggested that Mr Calder riding THE DOM may have contributed to the incident by dictating the line of MANRICO.

Submissions for Penalty:

Mr Oatham said  that Mr Coonee was very inexperienced and has only had 5 rides. He said that this situation could be put down to his inexperience. He said that Mr Coonee had the opportunity to roll forward but chose to ease back and this caused the problems.

He submitted that the incident was in the low to midrange level of seriousness.

Mr Harris referred to Mr Coonee's inexperience and said that he was concerned that a Rider of Mr Coonee's inexperience was riding on a Premier day. He submitted that the incident was in the low level of seriousness.

Mr Harris also said that Mr Coonee wanted to start his suspension straight away.

Reasons for Penalty:

The race films showed where Mr Coonee had options at the time and he could have gone forward but he took a more cautious approach. It seemed to us that when Mr Coonee was moving in his horse appeared to jump over the heels of Mr Calder's horse. In any event Mr Coonee's inexperience was shown in his manoeuvre but he did cause interference.

The incident in our view falls into the low level of seriousness and we take a starting point penalty of 6 National Riding days and give Mr Coonee credit for his admission of the breach and  his inexperience and reduce it to 5 days.

We also take Mr Harris' point that perhaps an Apprentice as inexperienced as Mr Coonee should not have been riding on a Premier day and Trainers would do well to keep that in mind for the future.
