Decision:

As Mr Johnson admitted the breach of the Rule the charge was found proved.

Penalty:

Mr Johnson’s Jockey’s Licence was suspended from the conclusion of racing on 8th November 2012 until the conclusion of racing on 12th November 2012, incorporating three racing dates.

Charge:

Following the running of Race 7, DUNEDIN CASINO 1400, an information was filed by Stipendiary Steward Mr Davidson, against Licensed Jockey, Mr C Johnson, alleging a breach of Rule 638 (1) (d) in that Mr Johnson, as the rider of "The Diamond One" in the race, "…passing the 350m Mr Johnson permitted his mount The Diamond One to shift outwards and cause Just Frank (A Forbes) to be severely buffeted and lose momentum and ground. Also hampered was Motorboat Mike (D Prastiyou)".   
 
Rule 638 provides as follows:
(1) A rider shall not ride a horse in a manner which the Judicial Committee consider to be - (d) careless.

Facts:

Mr McLachlan, with the assistance of the Race Video, illustrated how Mr Johnson had shifted "The Diamond One" from its position one-off the rail, when trailing the leaders, and came into contact with "Just Frank" on his outer. He stated Mr Johnson had moved into a gap and in doing so had caused severe buffeting to both "Just Frank" and the inside runner "Motorboat Mike".
Mr Johnson submitted that it was a case of two horse/jockeys going for the same gap, but admitted it was not an excuse.

Submissions for Penalty:

Mr Davidson told the committee that Mr Johnson had not appeared before a judicial committee on a similar charge since December 2011. He said his riding record since then had been extremely good for a senior jockey who rode on a regular basis nationally. However, Stewards believed the level of interference was mid range and a suspension of four race days would be an appropriate penalty.
Mr Johnson accepted Mr Davidson’s submissions. He did not request the committee to grant a seven day deferment.

Reasons for Penalty:

The Committee determined a starting point of 5 days suspension as appropriate.  We took into account Mr Davidson’s submissions regarding Mr Johnson’s good record, his early admission and co operation with the Stewards. We agree with Mr Davidson the interference was mid range. We gave credit to Mr Johnson on his excellent riding record over the past 11 months and that any suspension would include a Premier Day at Canterbury.  Accordingly we considered a suspension of three racing days nationally as an appropriate penalty.
