As Mr Hutton admitted the breach we found the charge proved.

Penalty:

 Mr Hutton is suspended from the close of racing on Thursday August 15th up to and including racing on Thursday August 22nd.  Race days in this period are:

17/8/13                                Waikato/Otaki

19/8/13                                Taupo

21/8/13                                Waipa

22/8/13                                Woodville

Charge:

Following the running of Race 6, the Bay Ford 2013 Punter of the Year 1600m, an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1) (d) in that B Hutton angled his mount PORT ELIZABETH out to improve passing the 400 metres when not clear of RAPT IN GOLD which was checked and forced onto the hind quarters of A’ROSA BLU.

Facts:

Mr Oatham read the rule and Mr Hutton said he understood the nature of the charge and confirmed that he admitted the breach. Mr Hutton is an apprentice rider attached to the Murray Baker and Andrew Forsman stable. Mr Forsman was present at the hearing to assist him.

Mr Neal identified the affected horses and riders on the video and outlined the incident. Mr Hutton was towards the rear of the field and trying to improve his position. On rounding the bend for home he angled his mount outwards causing interference to two horses on his outside.

Mr Hutton explained that his horse was travelling much better (than the other horses around him) and he had to give it every chance in the running. When he angled outwards and pushed forward he did not see Ms Dravitski as she was in his blind spot.

Submissions for Penalty:

Mr Oatham produced Mr Hutton’s riding record which showed two suspensions for careless riding both on the same day in January this year. Each suspension incurred a four day suspension. Mr Hutton has had approximately 160 rides in 10 months so his record is a good one. He said Mr Hutton had been impatient in today’s ride and if he had only waited for 50 metres before angling outwards he would have not caused the interference he did. Mr Oatham said the Stewards considered the degree of carelessness to be in the low to mid range.

Mr Hutton acknowledged that he might have been a bit hasty however said he had an obligation to give his horse every chance to win the race. Mr Forsman submitted that the incident was the result of inexperience and bad timing. If Mr Hutton had waited to make his run there would have been no problem.

Mr Hutton advised of riding commitments through until Thursday August 15th. It was established that at this stage he was riding only in the North Island.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions and adopted, as a starting point, a period of five days suspension. Mr Hutton has had only one season of riding and today’s incident did appear to be the result of inexperience however the interference he caused was not insignificant. We have given him credit for his admission of the breach and his good record reducing the penalty to one of a four day suspension. The committee reminded Mr Hutton that in giving his mounts every opportunity to win races he could not lose sight of safety and had to ensure that he was the required distance clear of other horses when changing ground.
