Mr Douglas’ Class D Jockeys licence is suspended from the conclusion of racing 15 August up to and including 25 August. Effective meetings within this period of suspension are Wanganui on 19 August and Te Rapa on 25 August 2018.
Facts:
Following the running of Race 1, the Trevinos Bar & Restaurant Maiden Hurdle, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Class D Rider, Mr L Douglas, alleging careless riding in that he allowed his mount SHEEZOFF to shift inwards near the 700m when not sufficiently clear of ONEFORTHEDITCH, which was forced inwards onto THE HUNTSMAN which struck a heel.
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Douglas had indicated on the Information that this breach of the Rules was admitted, which he confirmed at the hearing. Mr Douglas also agreed that he understood the charge and the Rule it was brought under.
Mr McLaughlin, with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that nearing the hurdle at the 800m, Mr Douglas riding SHEEZOFF, was racing in a 3-wide position with ONEFORTHEDITCH, ridden by Mr A Kuru, in a 2-wide position and THE HUNTSMAN, ridden by Mr S Fannin, on the rail. He pointed out on the films that after jumping the hurdle Mr Douglas was still in a 3-wide position with Mr Kuru and Mr Fannin, on his inner. Nearing the 700m, Mr Douglas, he said, allowed his mount to shift inwards when under a ride and not clear of Mr Kuru who was forced inwards onto Mr Fannin who struck a heel. Mr Oatham stated that there was some mitigation for Mr Douglas, as SHEEZOFF was laying in on the point of the turn which did not help the situation.
Mr Douglas elected to make no submissions in regard to the incident.

Mr McLaughlin stated that Mr Douglas had a clear record in relation to this rule, was visiting from England and had ridden on 25 occasions including today. He said the level of the breach was low with mid to high consequences as a horse has clipped a heel. Mr Oatham stated that the usual starting point for suspension penalty for a jumps rider was a 3-day suspension. He said that credit should be given to Mr Douglas for his admission of the breach and his clear record.
Mr Douglas requested a deferment of penalty until after Wednesday 15 August as he had confirmed rides at the Te Aroha meeting on that date.

We took into consideration all factors including the low level of the breach, the mid to high consequences, Mr Douglas’ clear record and his admission of the breach. This Committee determined that a 3-day starting point was appropriate as Mr Douglas was a Class D jumps rider. There were no aggravating factors to consider, so no uplift in penalty was warranted. We were however able to afford Mr Douglas a combined discount for his admission of the breach and his good record which we set at 1 day. We therefore determined that a 2-day suspension was an appropriate penalty in this case. Mr Douglas’ request for a deferment of penalty until after racing at Te Aroha was granted.
