Accordingly the protest is dismissed and the Judge's placings shall stand. In conclusion we order the payment of stakes and dividends.
Facts:
Following the running of Race 1, Dunstan Breed And Grow Premier, an information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Mr Sweeney, alleged that THEDEPOT placed 3rd by the Judge interfered with the chances of MAGIC BELLE placed 4th by the Judge.
The interference was alleged to have occurred in the final straight.
The Judge's placing were as follows:
1st No. 9 HOLY AFFAIR
2nd No. 12 BEST COMMAND
3rd No. 4 THEDEPOT
4th No. 7 MAGIC BELLE
The official margin between 3rd and 4th was a short neck.
Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.
Submissions for Decision:
Mr Sweeney told the Committee that shortly before the post he was kicking on strongly when Thedepot ran in on 2 occasions which caused him to be crowded. This resulted in him having to take a hold and stop riding for 3 or 4 strides. He believed that with the short neck margin at the post he would have finished in front of Thedepot if interference had not occurred.
Mr Ralph concurred with Mr Sweeney's submissions and had nothing further to add.
Mr Du Plessis submitted Thedepot was having its 3rd start and was still very green. He said his mount ran away from the winner Holy Affair when Mr Jago was using his whip in the left hand. He said he also had to stop riding for several strides to correct his mount. He went on to say once the winner was clear of him his mount Thedepot ran truly to the line. He summed up by saying his mount would have still beaten home Magic Belle if no such interference had occurred.
Ms Lawrence submitted that Mr Du Plessis had to stop riding Thedepot which caused him to lose momentum.
Mr Neal when asked for the Stewards' interpretation of the alleged interference submitted that Mr Du Plessis has shifted in for 2 to 3 strides over the final stages of the race which he described as a battling finish. He added that it was significant that Mr Du Plessis also had to stop riding and therefore the Stewards had reasonable doubt that Magic Belle would have beaten Thedepot if interference had not occurred.
Mr Sweeney when given the opportunity to sum up had nothing new to add.
Reasons for Decision:
The Committee carefully considered all evidence and submissions presented and reviewed the video films several times. We established at the 200 Thedepot was 1 length ahead of Magic Belle and there was a noticeable gap between the 2 horses. At this point Magic Belle was under a hard ride and not making ground on Thedepot. Approaching the 100 metre mark Thedepot was approximately ¾ of a length ahead of Magic Belle when it rolled in crowding Magic Belle. The Committee accepts that Mr Sweeney did have to take a hold of Magic Belle for 2 to 3 strides. At the same time the films show that Mr Du Plessis also had to stop riding his mount forward to correct the inward movement which in turn resulted in him also losing momentum. Although Magic Belle did gain approximately a neck on Thedepot over the final stages we do not believe this was sufficient to warrant a change of placings.
For these reasons we are not satisfied that Magic Belle would have beaten Thedepot if interference had not occurred.
