The protest is dismissed and the official placings will stand. 

Facts:

Following the running of race 7, the ZM F&M Maiden 1400m, Mr M Pitman lodged a protest against the second placed horse I’m A Taart alleging interference to Perfection approximately 200m from the finish.

Protest rule 642 (1) reads: If a placed horse or its Rider causes interference within the meaning of this Rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse after the horse interfered with.

The official margin between 2nd and 3rd placings was 1¾ lengths.

Mr Davidson (Stipendiary Steward) demonstrated on the video that approaching the 200m mark Ms Direen allowed her horse I’m A Taart to shift inwards when not sufficiently clear of Perfection (J Bullard) causing Mr Bullard to check his horse. Ms Direen had shifted inwards about two horse widths taking Perfection's line. He stated that Perfection was racing on the inside of Keep The Quest (Jo Chong) and had established a run.

Submissions for Decision:

Mr Pitman, with the use of the video, said his runner had established a clear run and was entitled to the gap. The interference from Ms Direen’s mount caused his horse to be severely checked and lose momentum. This cost his horse at least five lengths. He believed his horse would have beaten I’m A Taart at the finish. 

Mr Bullard stated he had gone for the gap which he believed he was entitled to. When Ms Direen’s mount came across in front of him he was forced to check, this caused his mount to lose momentum. He had to then rebalance his horse by which time Perfection had gained 4 ½ to 5 lengths on him. The margin at the finish was 1 ¾ lengths. He believed the interference cost him a chance of running second.

Ms McKay stated that in her opinion Perfection never had a clear run at any stage prior to the interference. She said Mr Bullard was attempting to force his way out and was bumping Keep The Quest on his outer. She also said that The Bubbly One (Kylie Williams) was ahead of Mr Bullard. She also stated that Ms Direen had had to straighten her horse also.

Ms Direen stated that prior to the 200m she had used the stick on I’m A Taart a couple of times. The horse had shifted inwards and she had been forced to stop riding her mount and straighten up to prevent coming into contact with Ms Williams' mount The Bubbly One.

Reasons for Decision:

The committee has to be satisfied that the interference and the subsequent official margin of 1 ¾ lengths warrant a change of placings. The committee is satisfied that I’m A Taart did cause interference to Perfection about the 200m mark. However the committee recognises that prior to the interference Mr Bullard’s mount was engaged in a bumping incident with Keep The Quest on its outer. Also, there is some doubt as to whether Perfectionist did in fact have clear forward racing room at the point of the interference taking place. The official margin of 1 ¾ lengths is also significant.

The committee is not satisfied that the interference, given the distance from the finish which it occurred, combined with the official margin, warrant a change of placings.
