This charge arises following the running of Race 4, The Avondale Sunday Markets 1600 metres. The Informant, Senior Stipendiary Steward Mr M Williamson, alleged that Mr Reuelu left a towel off, when saddling SATRIANI which was subsequently disqualified from (1 kg light) 3rd place.
Rule 614(2) provides that:
A person must not be neglectful or careless in saddling a horse.
At a previous (Request for a Ruling) hearing following the running of Race 4, the 3rd placed horse SATRIANI was disqualified due to its rider, Mr Hashizume weighing in approximately 1 kg light. It was agreed by all parties that the evidence from the earlier hearing was accepted for the purpose of this hearing in terms of assessing Mr Reuelu’s liability and penalty.
Mr Reuelu advised that he is the Wallace Stable Foreman, and he was responsible for correctly saddling SATRIANI. He said that the horse’s official trainer is Ms C Evans and he was filling in for her as she was out of Auckland. Mr Reuelu advised that he is also the owner of SATRIANI.
Mr Williamson reconfirmed that following the running of the race the rider of the 3rd placed horse Mr Hashizume (SATRIANI) weighed in approximately 1 kg under his allocated handicapped weight. As a result, SATRIANI was disqualified.
Mr Williamson said that once the issue was investigated it was immediately established that the towel had been left off when saddling. The towel in question was recovered from the saddling area.
In explanation Mr Reuelu accepted that the towel had been mistakenly omitted. He said that the stable had brought 3 towels to the races, all the same type and colour and somehow there had been a mix-up between the towels to be used for racing and the one to be used for wiping the horses down. He said that the towel omitted had been used for wiping down the horses; it was wet and therefore heavier than usual, thus accounting for the 1 kg discrepancy at weigh-in.
Submissions for Penalty:
Mr Williamson advised that Mr Reuelu is the holder of a miscellaneous license. He said he has a clear record. He identified the disqualification of SATRIANI as an aggravating factor. In mitigation he advised that the breach was freely admitted and Stewards believe it was a genuine mistake. He submitted that a fine somewhere between $500 and $1000 would be an appropriate penalty.
Mr Reueleu said he would receive a fine, but may struggle to pay it off if it were substantial. Mr Reuelu was genuinely remorseful.

The Penalty Guide for Judicial Committees provides a starting point of a $750 fine where there is neglect in saddling when there are consequences for the betting public and owners.
Careful consideration was given to the evidence and submissions that were presented. In particular the Committee weighed up the following factors: (1) Mr Reuelu’s culpability; (2) the disqualification of SATRIANI; (3) the loss of $700 in stake money for finishing in 3rd place; albeit Mr Reuelu is the owner; (4) the betting public who were denied a dividend; and (5) Mr Reuelu’s admission of the breach and his remorse.
Taking these factors into account the breach is assessed as mid-range. Accordingly, from a starting point of $750 a modest $50 uplift is applied.
