 Accordingly Mr Hannam is fined the sum of $150.

Charge:

Following Race 9, the Bonny Glen Landfill Handicap, an information was lodged by the Stewards alleging a breach of Rule 638(3) (b) in that R Hannam the rider of ST RANSOM used his whip excessively prior to the 200 metres.

Facts:

Mr Goodwin showed the video footage of the home straight. Mr Hannam was racing near the front of the field and after rounding the bend for home was seen to strike his horse 10 -11 times consecutively prior to the 200 metre mark. This is clearly outside of the guidelines pertaining to whip use. Mr Hannam finished in second placing.

Submissions for Penalty:

Mr Goodwin said Mr Hannam had a very good record under this rule with no breaches in the last 12 months. The Stewards’ submission was for a monetary penalty in the vicinity of $150. They based this on recently imposed penalties which ranged from $150 - $300.

Mr Hannam acknowledged that he was well aware of the guidelines but explained to the committee that if he had stopped using the whip his momentum would have been affected and he may not have run second.

Reasons for Penalty:

The guidelines for whip use in New Zealand are well recognised and understood by riders. Prior to the 200 metres they are only permitted to use the whip for six strides and then they must ride hands and heels for six strides. Mr Hannam appeared to hit his mount 10 – 11 times without respite prior to the 200m mark. While we place this breach at the lower end it was explained to Mr Hannam that potentially running into a dividend bearing place was not an excuse to break the rules. In setting penalty we have taken into account Mr Hannam’s very good record, his admission of the breach, the number of strikes over the guidelines and previous recent penalties.
