As Mrs Barclay had admitted this breach of the Rules it was found to be proven in accordance with Rule 869 (4).
Penalty:
Accordingly Mrs Barclay was fined the sum of $300 and suspended for 1 race day. Mrs Barclay may resume driving following the Forbury Park TC meeting on the 10 March 2011. Mrs Barclay was reminded of her professional responsibilities.

With approximately 400 metres remaining Mrs Barclay shifted outwards when not in a position to do so which resulted in 'Squeezemegently' being checked into a gallop and losing its chance in the race.
Alleging a breach of Rule 869 (4).
Facts:
Following the running of Race 5, an Information (68860) alleging a breach of Rule 869 (4) was lodged by Mr N Ydgren, Stipendiary Steward . It was alleged that with approximately 400 metres remaining Mrs Barclay shifted outwards when not in a position to do so which resulted in 'Squeezemegently' being checked into a gallop and losing its chance in the race.
Submissions for Decision:
Mr Ydgren used the video film to show where he believed Mrs Barclay had moved outwards , causing Squeezemegently to gallop, losing all chance.
Mrs Barclay did not dispute the evidence as presented.
Reasons for Decision:
The Committee was satisfied that a breach of Rule 869 (4) had occurred, and that Squeezemegently was checked into a gallop through no fault of its own.
Submissions for Penalty:
In relation to penalty, Mr Ydgren advised that Mrs Barclay had a 'Crystal clear' record over the previous 12 months. Mrs Barclay had had some 2164 drives, 91 of them this season. Mr Ydgren also stated that Mrs Barclay was an exceptional horsewoman, but that the consequences of her carelessness resulted in a relegation. Mrs Barclay drove approx. 3-4 times each meeting. Mr Ydgren suggested a starting point of $600 dollars and that a suspension be considered.

In considering an appropriate penalty the Committee took into account that this breach was admitted, and that Mrs Barclay had an excellent driving record, with no breaches under this rule. We also took into account the number of race drives that Mrs Barclay regularly had.
