As Ms Satherley admitted the breach the Committee found the charge proved.

Penalty:

The Committee granted Ms Satherley a deferment to her suspension pursuant to Rule 1106(2). Accordingly, her licence to ride in races is suspended for a period of 4 days commencing after racing on 24 October 2020 and concluding after racing on 29 October 2020.

Facts:

This charge arises from the running of Race 5, the Auckland Co-Op Taxis 1600. Senior Stipendiary Steward Mr Williamson filed an Information pursuant to Rule 638 (1)(d) alleging the rider of JACK THE LASS (L Satherley) allowed her mount to shift in when not clear of HAKUNA MATATA (D Danis) which was crowded and checked near the 100 metres.

Ms Satherley acknowledged she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Using available video footage Stipendiary Steward Mr Coles demonstrated the incident and identified all horses and riders concerned. He said that in the home straight, approaching the 150-metre mark, Ms Satherley was denied a run between two runners.  She then changed ground and close to the 100-metre mark angled inwards seeking another run into a marginal gap. He said at that point FLEURGUNDY who was racing one off the rails on the inside commenced to shifted outwards and this caused the gap that Ms Satherley was seeking to close. As a result, Mr Danis’ mount HAKUNA MATATA, who was racing on the inner of JACK THE LASS had to be taken hold of and was checked for a stride or two.

In response Ms Satherley accepted that she should have waited a little longer for the gap to emerge. She said that her mount was being dictated to throughout the race which she described as being very “messy”. 

Submissions for Penalty:

Mr Williamson produced Ms Satherley’s riding record which indicated 1 previous breach under the careless riding Rule in the last 12 months. He said her riding record is very good given that she had 282 rides during the past racing season.

Mr Williamson said Stewards assessed the level of carelessness in the low range due to there being a number of contributing factors in Ms Satherley’s favour. He accepted that the run up the home straight was “messy” as was described by Ms Satherley. He submitted that any proposed suspension should be commensurate with a low range penalty.

Ms Satherley sought a 7 day deferment to any proposed suspension.

In terms of penalty Ms Satherley offered no submissions.

Reasons for Penalty:

After considering the submissions and reviewing the race film the Committee determined Ms Satherley’s carelessness to be in the very low range and adopted a 6-day starting point. This is in conformity with the Penalty Guide for Judicial Committees which recommends a 6-day starting point for low range carelessness.

The available films established that Ms Satherley attempted two marginal runs and on both occasions the gaps closed. The Committee accepts that there are extenuating circumstances in Ms Satherley’s favour in that other horses and riders contributed, therefore lessening her culpability.

There are no particular aggravating factors associated with the breach.

Ms Satherley has an excellent riding record. Whilst this is her 2nd breach within 12 months, the Committee understands that up until this breach she had only 1 previous breach of the rule in 2 ½ years (since May 2018), which is admirable for a relatively busy rider. On that basis we afforded her a 2-day reduction for her admission of the breach and her riding record.

After taking into account all the above factors the Committee considered that an appropriate suspension was 4 (national) days.
