Mr Norman is fined the sum of $300 and reminded of his professional obligations in respect of this Rule.

Facts:

Mr Munro, Stipendiary Steward, alleged that Mr Norman (COOLHAND EASTON) used his whip with his foot free of the footrest in the last 100 metres of race 3.

Mr Munro demonstrated the alleged breach on the videos. With some 100 metres to race and, after activating gear on the second attempt, the Respondent’s left foot slipped out of the footrest. Mr Norman then used the whip three times before placing his foot back in the rest.

Mr Norman said he was not aware that his foot had slipped from the rest. He agreed the video showed three strikes at the time his foot was out of the rest.

Mr Munro produced Mr Norman’s record. He has had 3855 lifetime drives — 32 drives this season and 20 last season. He said Mr Norman was primarily a trainer/driver of his own team. The aggravating factor was that Mr Norman had been issued with an Infringement Notice in the sum of $100 for a similar breach on 8 February last. Hence why this matter was before the Committee as a charge.

Reasons for Penalty:

Mr Norman used the whip on three occasions while his left foot was out of the footrest. It is clear he had been having issues with activating gear. There is nothing to suggest that the breach was deliberate. The Penalty Guide suggests a starting point of a $300 fine, which is appropriate on this occasion.
