As the breach was admitted we find the charge proven.

Penalty:

After taking all the above factors into account we impose a suspension on Mr Peard from riding in races which is to start after racing on 14 November and conclude after racing on 21 November 2010 (4 riding days).

Charge:

Following race 5 an Information was filed pursuant to rule 638 (1) (d). The informant Mr Oatham alleged that Mr Peard permitted his mount ENSOLEILLE to shift inwards when not clear of LOVISTE (A Ng). This resulted in further crowding to ANGELWITHATTITUDE

Mr Coles demonstrated the video films which showed ENSOLEILLE racing on the outside of the field approaching the 800 metres. It was evident on the films that Mr Peard let his mount drift in on the point of the turn when insufficiently clear of LOVISTE making contact between the 2 horses. ANGELWITHATTITUDE who was inside LOVISTE on the rail was also hampered causing it to be checked.

Mr Oatham said Mr Peard had a good record with 2 charges in the last 12 months. However although Mr Peard had pulled off it was too late and Miss S Collett received quite a severe check as a result. Mr Oatham submitted Mr Peard’s carelessness was in the mid to low end range. 

 
Mr Peard confirmed to the committee he did not have any commitments after 14 November.

Reasons for Penalty:

The committee carefully considered all evidence and submissions. In Mr Peard’s favour are his very good record and his admission of the breach. However Miss Collett did suffer a reasonably sharp check as a result of Mr Peard moving in when insufficiently clear.
