Facts:
Following the running of Race # 1 the MORRISON’S SADDLERY TROT Stipendiary Steward Mr N Ydgren lodged an Information alleging that Mr JR Dunn (SUNDOWN IN PARIS) drove in a careless manner - Rule 869 (3) (b) - when allowing SUNDOWN IN PARIS to shift outwards when not in a position to do so which in turn caused PARADISE SPUR (MP Jones) to break. The incident occurred approx. 175m from the finish.
Submissions for Decision:
Mr Dunn admitted the charge and indicated he did not wish to appear before the committee. Due to the nature of the charge the committee requested Mr Dunn to attend and did not convene until he appeared later in the day. At the start of the hearing Mr Dunn was given the opportunity to explain why he did not wish to attend. He stated he did not believe he would receive a fair hearing from the Chairman of the committee. His objection was noted and he chose to leave the hearing at that point.
With the use of both head-on and side-on videos Mr Ydgren stated that approx. 150m from the finish SUNDOWN IN PARIS was racing near the rear and midfield. In attempting to secure a clear run Mr Dunn shifted outwards when not clear of PARADISE SPUR, allowing his horse to come into contact with that runner. On the outside and slightly forward of Mr Jones was another runner. Mr Jones had nowhere to go and as a result his horse broke and lost any chance.

Mr Ydgren stated Mr Dunn had a clear record for the past 12 months in regards to a breach of this rule and had admitted the charge at the outset. He believed that had Mr Dunn waited a few more strides this incident could have been avoided. He believed the level of interference was low to mid-range. Stewards were seeking a fine of between $200-$400.

The committee took the following into account; the level of interference was at the lower end of the scale, Mr Dunn admitted the charge at the outset and had a clear record for the past 12 months.
