Facts:

Mr Allison, stipendiary steward, alleged that horse 9 COMMANDER JEWEL or its driver placed 2nd by the Judge interfered with the chances of horse 8 WHITNEY placed 7th by the Judge near the 850 metres.

Submissions for Decision:

Mr Allison demonstrated on the available videos that as the horses rounded the bend coming out of the home straight Mr Todd allowed his horse to drift in with the consequence there was interference to WHITNEY, which broke. He said Mr Heads, the driver of WHITNEY had moved from 2 to 3 wide and was clearly established in that position as Mr Todd improved on his outer.

Mr Heads gave evidence that he had run out of room and there was contact between the cart of COMMANDER JEWEL and a back foot of WHITNEY. He said he was concentrating on keeping his horse trotting rather than yelling. He had thus not called out to Mr Todd. He said he had sufficient room until the point of the corner. He pointed out Mr Norman had improved into the position he had just vacated thus there was nowhere for him to go when he was squeezed by Mr Todd. WHITNEY, he said, was going well at the time and he thought it had a good chance of finishing in a stakes bearing position.

Mr Todd said Mr Heads was trying to push him out. He said the video demonstrated that his horse was having trouble handling the bend and the cart was sliding. He said there was no yelling from Mr Heads and he did not think there had been contact. He added he was not trying to hold Mr Heads in. He was just trying to hold his own position. Mr Cox, speaking on behalf of Mr Todd, said Mr Heads had just come out 3 wide he did not believe the respondent was trying to push Mr Heads back down.

Reasons for Decision:

We are satisfied that Mr Heads had legitimately moved from a two wide to a three wide position and was clearly established in that position when he suffered interference. This was on the apex of the bend out of the home straight. We are satisfied that Mr Todd had given Mr Heads sufficient room until this time. It is a notorious “black-spot” on the Forbury track as drivers improving on the outer of the field tend to miscalculate the amount of room horses racing on their inner require. We believe this is another example. Mr Heads had Mr Norman on his inner had had nowhere to go when he received pressure from COMMANDER JEWEL. The consequence was contact and Mr Heads’ horse galloping and losing its position in the field.

In exercising our discretion to relegate COMMANDER JEWEL to behind WHITNEY we are satisfied that WHITNEY suffered interference, that the cause of that interference was inwards movement from COMMANDER JEWEL when that horse was not sufficiently clear of WHITNEY. The consequence was that the chances and progress of WHITNEY, which Mr Heads says was travelling well at the time, and which the videos does not discount, were interfered with.
