Accordingly, Ms Myers' license is suspended from the close of racing on Wednesday, May 1st up to and including racing on Thursday, May 9th 2019. We are aware that this time frame includes a premier day at Riccarton.
Facts:
Following the running of Race 3 (Hawke’s Bay Owners Association Mile), an Information was lodged by Mr D Balcombe alleging a breach of Rule 638(1) (d) in that R Myers (TUIGIRL) shifted out near the 300m when not clear of WAR OF WORDS (M Singh) which was hampered.
Using the videos, Mr Goodwin explained the incident.
Ms Myers was racing back in the field near the fence. On rounding the turn, she angled TUIGIRL outwards seeking a clear run further out on the track. Mr Singh who was already racing wide was forced out over extra ground when Ms Myers moved out wider than she intended. Mr Singh had to take some evasive action, and Ms Myers went on to win the race.
Ms Myers admitted making a run but said she was forced wider than she anticipated due to the mounts of Ms Satherley and Mr Hannam in front of her moving outwards.
Submissions for Penalty:
Mr Balcombe was invited to make submissions on penalty. He said Ms Myers had three previous careless riding charges over the last 12 months (a fourth charge at this same meeting a year ago was not counted).
Mr Balcombe described today’s breach as at the low-end of careless riding and submitted that a suspension in line with that be imposed.
Ms Myers made no specific submissions on penalty but advised of riding commitments through until racing next Wednesday at Wanganui.
Reasons for Penalty:
TUIGIRL was full of running, and with horses in front of her, Ms Myers had no option but to angle outwards to obtain a clear run. Unfortunately, in doing so, she went wider than intended and took the line of WAR OF WORDS when only ¾ length in front of that runner. Mr Singh had to take evasive action and was forced over extra ground. We accept that part of the reason Ms Myers went as wide as she did was due to the runners directly in front of her moving outwards at the same time. She had already committed to the run and had no option but to carry on this trajectory.
The Committee placed the degree of carelessness between low and midrange and adopted a starting point of 7 days.
While the Committee was concerned that Ms Myers had only recently returned to riding following suspension, we have, on this occasion, considered her record a neutral factor. We based this on the number of rides she has had over the last 12 months.
We have given Ms Myers credit for her admission of the breach and weighing up all factors consider a six-day suspension an appropriate penalty.
