Miss Haley alleged that in Race 8 horse number 4 SWELL TIME galloped in excess of 50 metres in the final stages of the race.
Miss Haley sought disqualification of SWELL TIME pursuant to r 1003(2).

Miss Haley demonstrated on the videos that SWELL TIME broke in the run home and galloped for a distance of approximately 60 metres.
Mr M Williamson, the driver of SWELL TIME, represented Mr Baucke, and did not contest the protest.
Reasons for Decision:
After viewing the videos from the various angles, the Committee is satisfied that SWELL TIME broke for a distance in excess of 50 metres. SWELL TIME was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
