Stipendiary Steward Mr J Muirhead showed the video film of the run home. Mr Herlihy struck his horse with the whip on 21 occasions.

Mr Muirhead said Mr Herlihy had breached this rule on the 14th October 2010 and been fined $200. He said other than that Mr Herlihy had a very good driving record. He said the offending was medium to high and submitted that a fine of $300 was appropriate.
