Penalty:

Miss Houston, you are suspended from race riding from after the completion of racing today until the completion of racing on Thursday the 14th of July (4 days).

Facts:

Miss. S. Houston admitted a charge of careless riding brought under rule 638 (1) (d) in that as the rider of Mt Sinai she allowed her mount to shift inward near the 800 metre mark when not clear of Karlos (R. Cully) who was checked.

Submissions for Decision:

Mr Neal using the available films pointed out the incident which occurred in the back straight. He informed the committee Miss Houston allowed her mount to drift across and into the line of Karlos (R Cully) causing that jockey to take hold. He believed that Karlos lost 2 – 3 lengths in the incident after becoming unbalanced. Because the incident happened in the back straight he was a little unsure whether the incident was a factor in the finish but did note the margins of a short head between Karlos, who finished second, and the winner Harvest The Gold.

Mr Neal submitted that the breach could be classed as in the mid range and Miss Houston could be considered a national jumps jockey.

Miss Houston informed the committee she thought her movement across and onto Karlos’ line was gradual and that she was sufficiently clear. She didn’t hear Mr Cully call and did confirm that her actions did cause Karlos to be checked.

Submissions for Penalty:

Mr Neal submitted that this was a prestigious jumping race and the incident may have affected the final placings. He classed the incident in the mid range and asked for a period of suspension to be imposed.

Mr Neal informed the committee that this was Miss Houston's first breach of the careless riding rule in over 900 rides over a number of years. He submitted that this was an exemplary record and should be taken into account when arriving at a penalty.

Miss Houston did confirm that this was her first charge under the rule, she was a busy rider during the jumping season and did indicate her desire to ride in the Wellington Steeplechase later in the month.

Reasons for Penalty:

In coming to our decision to impose a period of suspension we have taken into account your admittance of the breach and your exemplary riding record. We have noted your wish to ride at the Wellington Winter Meeting. However, this was a prestigious jumping race and your actions caused tightening to the horse on your inside. Karlos became unbalanced and lost a number of lengths in the incident.
