Facts:
Following the running of Race 9 an information was filed by Stipendiary Steward Mr S Wallis, against Open Horseman Mr M P Jones, alleging a breach of Rule 869 (4) in that Mr Jones:
“with about 1400m remaining you shifted down to trail the leader when not sufficiently clear to do so causing Mitchell Kerr to restrain Gliding Charm and forfeit his position”.
Rule 869 (4) provides as follows:
“No horseman shall during any race do anything which interferes with or is likely to interfere with his own horse and/or any other horse or its progress”
Mr Jones admitted the breach and elected not to be present. The charge was taken as read.
Submissions for Decision:
Mr Wallis with the assistance of the race video illustrated as the field entered the home straight with about 1400 metres to run, “Christian Steel” (Mr Jones), was travelling one back and parked outside “Gliding Charm” (Mr Kerr). Mr Jones shifted down in order to trail the leader when not sufficiently clear of “Gliding Charm”. As a consequence Mr Kerr was required to restrain his drive, forced into the passing lane, and required to ease onto the back of Mr Jones.
Mr Wallis submitted “Gliding Charm” received a check losing one full place in the race.
Mr Wallis advised the Committee Mr Jones believed the pace had quickened and he had room to ease down but had misjudged the situation.
Reasons for Decision:
Mr Jones admitted the charge. The Committee was satisfied from viewing the race video and hearing Mr Wallis' submissions, that as a consequence of Mr Jones' actions “Gliding Charm” was interfered with losing ground and a favourable racing position.
Submissions for Penalty:
Mr Wallis advised the committee Mr Jones was a particularly busy driver and had an excellent record in relation to this rule. He had been frank with the Stipendiary Stewards and his submission for penalty was for a fine of $200.
Reasons for Penalty:
The relevant Penalty Guideline for a first offence of this nature is $300 or 6 drives. The Committee took into account that Mr Jones had admitted the charge, he had been frank with the Stewards and had an excellent record relevant to this Rule. Accordingly in acknowledging these factors a fine of $200.00 was deemed appropriate.
