Decision:

In accordance with Rule 869(8) the committee ordered the relegation of Dralion to finish behind Omar.

The Judge's placings were amended as follows:

1st 1 Omar

2nd 2 Dralion

3rd 4 Benji M Brogden

4th 5 Vapour

5th 9 No Apachemee

Authority was given to pay on these placings.

Facts:

Stipendiary Steward Mr J Muirhead lodged an information initating a protest hearing following race 4.  It alleged that Horse 2 Dralion (P Baker) placed first by the judge had utilised the passing lane in the run home impeding the progress of Horse 1 Omar (Z Butcher) placed 2nd by the Judge.

Dralion's interests were represented by Trainer Mr A Neal, Driver Mr P Baker and part owner Mrs A Baker.  Junior horseman Mr Z Butcher represented the interests of Omar.

Mr Muirhead outlined the relevant details of the Passing Lane Regulations and Rule 869(4).

ss 4 of The Passing Lanes, False Rails and Home Straight Regulations states:

In the last lap of any race the leading horse on the running line shall, upon entering the home straight, maintain as straight a course as possible parallel to the running line and allow the trailing horses full access to the expanded inside lane

At the commencement of the hearing Mr Neal confirmed the connections of Dralion would not contest the protest and  Mr Butcher was subsequently excused.

The Judge's placings were:

1st     2     Dralion

2nd    1     Omar

3rd     4     Benji M Brogden

4th     5     Vapour

5th     9     No Apachemee

Margins were  a long neck, 3 3/4 lengths, 3/4 length.

Submissions for Decision:

Mr Muirhead referred the hearing to video footage of the concluding stages of the race and identified Dralion at the head of the field on the running line turning for home with Omar in the trail.  On approaching the passing lane Dralion moved inwards taking the rightful line of Omar who was improving.  Dralion remained in the passing lane preventing Omar from improving on its inside and impeding its progress.

Mr Butcher then moved out from the passing lane and was improving solidly against Dralion when the two crossed the finish line separated by a long neck margin.

Mr Neal told the committee that Dralion had a severe boring pole fitted and under a drive had dropped into the passing lane when it appeared.  The horse had been away from racing for about 18 months.

Mr Muirhead submitted that the committee had the option of either relegating Dralion behind Omar or ordering that horse's disqualification.

Mr Neal told the hearing that his horse was clearly in the wrong and deserved relegation behind Omar.  No other horses in the race had been affected by Dralion's conduct.

Reasons for Decision:

The committee was satisfied that Dralion had failed to maintain a straight line in the run home in breach of Rule 869 and the relevant Regulations.  By moving into the passing lane he had taken the option rightfully that of the trailing horse Omar who was subsequently impeded in its run to the finish line.

It was obvious that Omar was finishing more strongly than Dralion despite the interference suffered with the finishing margin being a long neck.  It was equally apparent that no other runners in the race were affected by the actions of Dralion.
