Facts:
Following the running of Race 1, the BISHOPDALE/BUSH INN TABS & TAVERN HAREWOOD MOBILE PACE an information was filed by Stipendiary Steward Mr S Renault alleging Mr D Reardon (Nic Mac Willy) breached Rule 869 (4) (6) (b) & (c) in that ..Mr D Reardon (Nic Mac Willy) shifted outwards at the 1100m mark forcing Special Delight to race wider on the track.
Mr Reardon admitted the charge but did not attend the hearing.
Rule 869 (4) (6) (b) & (c) reads:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.
(6) Subject to sub-rule 4 hereof:-
(b) a horse making a forward movement during any race shall not be forced to race wider on the track;
(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.
Mr Quirk, with the aide of the videos, outlined the relevant positions of the horses as they approached the 1100m mark. Mr Reardon (Nic Mac Willy) was four deep on the pole line approaching the 1100m mark. As the field rounded the bend Mr Reardon shifted outwards forcing Special Delight (M Hallett) to race wider on the track.
Mr Renault stated that Mr Reardon shifted outwards when not clear of Stylish Babe. Stylish Babe was forced to shift three wide without cover.
He said Mr Reardon, when spoken to by the Stewards and shown the film, admitted the charge.
Submissions for Penalty:
Mr Renault said Mr Reardon had a clear record this season. He had had 22 drives and had been reasonably successful in those drives. The Penalty Guide recommended a starting point of a $250 fine or five drives suspension. He was seeking a minimum fine of $200.
Mr Reardon had made no indication to the Stewards on a penalty submission.

Mr Reardon is given credit for his early admission of the charge and his excellent record. The incident is mid to lower range and a fine at the lower end is appropriate.
