Facts:
An Information was lodged by Stipendiary Steward, Mr B J Van Kan, against Licensed Trainers, M Purdon and G Payne, alleging that they presented MINNIE MOOSE without the notified blinds.
Mr Purdon had advised this Committee that he did admit the breach and did not wish to be present at the Hearing.
Mr Van Kan advised this Committee that this was the seventh breach of this Rule by the Purdon/Payne Training Partnership within the last year. He said that the last breach was on 8 November 2011.
Submissions for Penalty:
Mr Van Kan referred to previous penalties imposed on the Purdon/Payne Training Partnership and said that the most recent penalty was a $300 fine. He advised this Committee that although the Purdon/Payne Training Partnership race a large number of horses, that seven breaches in the last twelve months was excessive. He submitted that a further fine of $300 was appropriate in this case.
Reasons for Penalty:
The matter has been brought to the Committee because of the number of breaches by the Purdon/Payne Training Partnership. The number of breaches has also been recognised in the increasing amount of previous fines.
In this case, the Committee does believe that a fine of $300 is appropriate.
