Charge:
Stipendiary Steward, Mr C J Allison, alleged that A W Kyle (DAWNS BOY) permitted his horse to start from mobile barrier nine not from its correct position of unruly (4).
Facts:
Following the running of Race 1 The Mico Plumbing’s & Pipelines Mobile Trot, an information was filed by Stipendiary Steward, Mr C J Allison, alleging a breach of rule 862(2) had occurred, in that Mr Kyle started his horse, DAWNS BOY, from the incorrect barrier position behind the mobile.
Submissions for Decision:
Mr Allison used several video clips of the alleged incident, highlighting Mr Kyle's horse, DAWNS BOY, starting right up to the mobile gate in position (9).
Mr Allison also stated that Mr Kyle, at no point, made any effort to start his horse in the correct unruly position.
Mr Kyle did not dispute the fact that the horse had started from position (9) on the front line, however he believed that there were several mitigating circumstances as to why this had happened.
Mr Kyle stated that his horse was very competitive at the start, and often chased the gate hard, and in this case, there were no front line horses in front of him and this made it even more difficult to start his horse in the correct position.
Mr Kyle also stated that he had to keep the horse together in the first 200 metres, otherwise he would (fly to pieces), and that it was very hard to anticipate the speed of the mobile gate.
Mr Allison asked Mr Kyle if he knew that at the dispatch point, if he was in the incorrect position.
Mr Kyle responded by saying that he was aware that his horse was in the incorrect position.
Reasons for Decision:
The Committee was satisfied that there was a clear breach of the rule and thus the charge was found proved.
Submissions for Penalty:
Mr Allison stated that Mr Kyle had a clear record over the past twelve months and that it was Mr Kyle’s responsibility to ensure that he started his horse in the correct position.
Mr Allison continued to state, that all Mr Kyle had to do, was to ensure that his horse started back from the mobile gate.
Reasons for Penalty:
In determining penalty, the Committee had regard to Mr Allison’s comments and also took into account Mr Kyle’s driving record over the past twelve months.
