Mr Johnson admitted the breach and it is found proved.

Penalty:

Mr Johnson is suspended from the conclusion of racing on the 29th November up to and including the 10th December (6 National riding days).

Facts:

Mr Johnson was charged with a breach or r 638(1)(d) – careless riding – in that he allowed his mount HOMBRE to shift inwards when not sufficiently clear of GIVEHERAGO with resulting interference to ARE THERE near the 500 metres in Race 3.

Mr Johnson admitted the breach and appeared at the hearing.

Mr Oatham stated that HOMBRE had been caught wide during the running before improving towards the leaders nearing the 500 metres. Mr Johnson then shifted his mount inwards but was not clear of GIVEHERAGO. Miss Barnes was forced to restrain and shift GIVEHERAGO off the heels of HOMBRE which resulted in interference to ARE THERE. At no time was Mr Johnson sufficiently clear of the inside runner when he shifted his mount inwards.

Mr Johnson stated he thought he was clear but after viewing the video replays accepted he had made an error.

Submissions for Penalty:

Mr Davidson stated that Mr Johnson had three prior breaches of the rule in the past 12 months. The 1st December at a corresponding meeting at Otago last year (7 days suspension), 5th January at Greymouth (5 days) and more recently 13th November at Manawatu (4 days). Stewards viewed the breach at the low to mid- range and sought a suspension of 7 days. Mr Johnson had had 459 rides over the past 12 months and was a busy national jockey.

Mr Johnson accepted the submissions of the stewards. He said he had confirmed rides on the 29th November and did not seek a deferment of penalty.

Mr Johnson has three previous breaches of the rule. However two of those are pre-COVID and one is at a corresponding meeting 12 months ago. The more relevant breach was at Manawatu on the 13th November. A starting point of six days is appropriate.
