Charge:
Following the running of Race 4, CMP Canterbury and Cryovac Handicap Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Ms A J Laing, alleging that Ms Laing, as the driver of TARPORT SPIRIT in the race, “used the ends of her reins as a whip in the run home”.
Ms Laing had signed the Statement by the Defendant on the information form indicating, firstly, that she admitted the breach and, secondly, that she did not wish to be present at the hearing of the information.
Rule 866 provides as follows:
No horseman shall use in a race:
(b) the ends of the reins as a whip.
Facts:
Mr Renault showed a video replay of the final 200-300 metres of the race. He pointed out TARPORT SPIRIT, driven by Ms Laing racing on the inside in 4th placing. She had dropped her whip earlier in the race and, after shaking the reins at the horse, she pulled the reins from under her seat, put them together and flicked, or attempted to flick, the horse with them. Ms Laing had not struck the horse but only the shaft because the reins were not long enough. She only did this on 2 or 3 occasions. The Committee noted that TARPORT SPIRIT finished in 4th placing. Ms Laing’s actions were a breach of the Rule but were at the bottom end of the scale, Mr Renault said.

Mr Renault submitted that a fine of $100 was appropriate. Ms Laing had no previous breaches.
Reasons for Penalty:
The Committee could find no details of any recent charges under the particular Rule as a guide to an appropriate penalty in this case. The Committee was satisfied that a fine of $100 was an appropriate penalty having regard to Ms Laing’s admission of the breach, her previous good record and, finally, that the breach was very minor in nature.
