Mr Court admitted the breach, which we thus find proved.
Penalty:
A suspension is appropriate. We understand the meeting scheduled in Christchurch for 18 March has been rescheduled to Rangiora on 23 March. We suspend the defendant from driving from 19 to 23 March, inclusive. This is 3 South Island days.
Charge:
Mr Allison, stipendiary steward, alleged that Mr P Court (SIGN MAKER) shifted ground inwards when insufficiently clear of SCOTTISH UNION (Mr M Williamson) causing SCOTTISH UNION onto CALEB EL (Mr T Williams), which struck and dislodged pylons. As a result LITISHINORA broke.
Facts:
Mr Allison had Mr Wallis, stipendiary steward, demonstrate on 2 video angles that some 200 metres after the start, and when traversing the bend at the end of the home straight, SIGN MAKER, driven by Mr Court, crowded the 2 horses on his inner, with the consequence that CALEB EL struck a pylon, galloped briefly and went inside 2 pylons.
The parties eventually agreed that the defendant's actions were not the cause of LITISHINORA breaking.
Submissions for Penalty:
Mr Allison stated that Mr Williamson, who was racing immediately inside the defendant, had said to Mr Allison after the race that he yelled to the defendant to give him room. Mr Allison said to Mr Court’s credit, he had, but this was too late.

Mr Court said he was chasing his horse out of the gate to get to the front. He said he was almost clear of Mr Williamson, who had kicked up his horse. He stated he had relieved the pressure as soon as heard the yelling and asked us to take into account his horse was green, it was only its 5th start, and this was its first start for some 14 months. He submitted that we deal with the breach by way of a suspension.
Reasons for Penalty:
We believe the breach is mid range. CALEB EL was able to quickly regain its gait and there was no disruption to the field. The particular point on the track where this incident occurred is a notorious "black spot" with respect to interference shortly after the start of a 2200 metre race, but Mr Court is an experienced driver, who has driven on this track many times and he should have known to give the horses on his inner plenty of room when progressing out wide on the first bend.
We give him credit for an excellent record and his ready admission of the breach.
