Accordingly the protest is dismissed and the judge's placings shall stand.

In conclusion we order the payment of stakes and dividends ac cordingly.

Facts:

Following race 3 Mr J Sargent, trainer of the fourth horse DEMOPHON, lodged a protest pursuant to rule 642 (1).  He alleged that ROYAL BLISS, placed third by the judge, caused interference to DEMOPHON in the final straight.

The judge's placings were as follows:

11 LUCY IN DISGUISE   1st

 5  FANTASTIC TIMES   2nd

14 ROYAL BLISS   3rd

 3  DEMOPHON   4th

 8  CONNIE BE GOOD   5th

The official margin between 3rd and 4th was a long neck.

Submissions for Decision:

Mr J Sargent demonstrated the video films which showed his horse DEMOPHON racing in the one one position soon after turning for home. He said DEMOPHON was bumped on 2 or 3 occasions at the 300 metre mark. Mr Sargent said that as there was only a long length between third and fourth at the post he believed this could have cost his horse third placing.

Mr Scriven, RIDER OF DEMOPHON said he was pushed from a 3 wide position to one of 5 wide through the outward movement of ROYAL BLISS at the 300 metre mark. He said that after the interference his horse became unbalanced but still finished the race strongly.  He had no doubt he would have beaten ROYAL BLISS if he had not been moved out from 3 wide to 5 wide. 

Mr R Priscott, trainer of ROYAL BLISS, had nothing to say when asked.

Mrs L Satherley, rider of ROYAL BLISS, said the interference occurred at the top of the straight through both horses coming together. She said for the last 300 metres the rider of DEMOPHON did not stop riding and he was still unable to make ground on her.

Mr George, when asked for his appraisal of the incident, said that although ROYAL BLISS was held up at the 300 metres when being angled out for a run, DEMOPHON contributed to the incident by trying to hold ROYAL BLISS in. Therefore he submitted the protest should be dismissed.

Reasons for Decision:

The committee carefully considered all evidence and submissions and reviewed the video films. We are satisfied that there was contribution to the incident from both horses at the 300 metre mark. Further it was clear that from this point DEMOPHON, when ridden strongly with the whip, did not take any ground off ROYAL BLISS. For those reasons the committee is not satisfied that DEMOPHON would have beaten ROYAL BLISS if interference had not occurred.
