As the breach was admitted we find the charge proved.
Penalty:
After taking all the above facts into account and under the provisions of rule 1106 (2) we find the appropriate penalty is a 4 day suspension. Accordingly we suspend Mr Jago from riding in races which is to commence after racing on 8 June and conclude after racing on 15 June 2013 (4 days).
Charge:
Following race 2, The Climate Control 2 Year Old, an information was filed pursuant to rule 638(1)(d). The informant alleged that Mr Jago permitted his mount SUKI LEE to shift outwards when not sufficiently clear taking ANOTHER EMPEROR wider into the line of MATAGOURI which was hampered and forced onto KLEVER GIRL.
Rule 638(1) (d) states: A rider shall not ride a horse in a manner which the judicial committee considers to be careless.
Facts:
Mr Oatham demonstrated the video films and pointed out at the 350 metres Suki Lee commencing to shift out when being ridden with the whip. He conceded that Mr Jago did stop riding with the whip at that point and swap his whip hand. Mr Oatham said however that Mr Jago then continued to ride forward with the whip while his mount was continuing to shift out over considerable ground. He was of the view that Mr Jago's actions may well have cost Another Emperor second placing. Mr Oatham highlighted the fact that Suki Lee did respond when being straightened at the 100 metres and said that if Mr Jago had taken this action earlier in the straight the charge would not have been presented.
Mr Jago submitted his carelessness was minimal and he had a clean record.

Mr Williamson submitted the breach was in the low to mid range because Mr Jago had moved out a significant distance in the straight. He said Mr Jago had incurred one suspension in the last 12 months.
Mr Jago confirmed to the committee upon questioning that he only rode in the North Island. He said he had commitments up to and including 8 June. He concluded by saying his carelessness was minimal.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. Mitigating factors are Mr Jago's admission of the breach and his very good record. However these factors must be balanced against the level of carelessness which the committee independently assesses in the low to mid range. This breach was caused by Mr Jago not straightening his mount when moving out over considerable ground while dictating the line of 3 horses on his outside.
