As Mr Mudhoo has admitted the breach, it is found to be proved.

Mr Mudhoo’s licence is suspended for 9 National days. This is from the end of racing on 26 January up to and including 13 February 2019.
Facts:
Mr Davidson alleged that Mr Mudhoo (FROSTED) in race 7, the LIQUORLAND GORE GUINEAS, permitted his mount to shift outwards passing the 150 metres causing WEAPONRY (J Laking) to be crowded and HIGHLY UNLIKELY (K Chowdhoory) to be checked.
Mr McLaughlin, Stipendiary Steward, demonstrated on the films that Mr Mudhoo had permitted his mount to drift into the line of WEAPONRY. He said Mr Mudhoo had the stick out and had not straightened his mount quickly enough. When questioned by the Committee, he said it was a gradual shift outwards.
Mr Walsh spoke on behalf of Mr Mudhoo. He said it was a clear cut breach. However, he emphasised the respondent had not shifted out a lot. He estimated it to be about one and a half horse widths. The field was tight anyway and there was also some inwards movement from DREAMTESTA which had added to the crowding of Mr Laking.
When questioned by the Committee, Mr Mudhoo said he was aware that he was drifting outwards and realised now that he should have put the stick away.
Submissions for Penalty:
Mr Davidson said the RIU believed the breach was mid-range. He produced the respondent’s record which showed two recent suspensions. He said there should be an uplift in light of the status of the race.
Mr Walsh reiterated that there was not a lot of outwards movement. He emphasised that the respondent was a much improved rider these past few months. He did not disagree with the Stewards’ assessment of the gravity of the breach. Mr Mudhoo had nothing further to add.
Reasons for Penalty:
We believe that the breach is correctly assessed by Mr Davidson as being mid-range. Mr Mudhoo had his mount under a strong ride and has drifted out over some distance, taking the line of Mr Laking. Any impact upon Mr Laking of an inwards movement by DREAMTESTA was very much at the low end. It was Mr Mudhoo’s outwards movement that placed Mr Laking in difficulty.
The starting point is 8 national days. Mr Mudhoo’s record was very good up until December 2018 when he received 2 suspensions in short order: 5 days at Otago on 14 December; and 6 days at Tapanui on 23 December. Those breaches need to be viewed in the context that he is a fairly busy South Island apprentice.
We uplift our starting point to 10 days having regard to record and the status of the race. A one day’s credit is appropriate for Mr Mudhoo’s admission of the breach.
Mr Mudhoo sought a deferment of any suspension that we were to impose until after the Riccarton meeting on 26 January.
