As Mr Turner admitted the breach I find the charge proved.
Penalty:
Accordingly, I impose a suspension on Mr Turner which will commence after racing on 12 November and conclude after racing on 21 November (5 North Island days).
Facts:
Following race 9, Monitor New Zealand LTD 2200, an Information was filed pursuant to Rule 638(1) (d). The Informant, Mr Williamson, alleged that passing the 200 metres Mr Turner the rider of PEACEFULEASYFEELIN directed his mount out when not clear of PHEROZARDO which was checked.
Mr Turner acknowledged that he understood the nature of the charge and the Rule. Mr Turner advised me that he admitted the breach and did not require any assistance at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Jones identified that passing the 200 metre mark Mr Turner angled his mount out when only ¾ of a length clear. In doing so he shifted out 2 to 3 horse widths which resulted in PHEROZARDO being checked. He noted this placed Mr Innes, the rider of PHEROZARDO, in a bad spot and nearly clipped a heel.
Mr Turner informed me that he was making up good ground and admitted that he angled his mount out too sharply. He acknowledged that this resulted in Mr Innes having his rightful running line taken.
Submissions for Penalty:
Mr Williamson produced Mr Turner’s record which showed 2 previous breaches under this Rule in the last 12 months. He described the level of carelessness as mid – range and informed me that Mr Turner admitted the breach at the first instance. He added that Mr Turner was very co-operative with the Stewards.
Mr Turner advised that he had zero upcoming commitments and submitted that his suspension could start after racing on November 12. Mr Turner confirmed that he rode all over the North Island.
Mr Turner made no submissions on penalty.
Reasons for Penalty:
I carefully considered all the evidence and submissions presented. I have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Turner’s admission of the breach and his good record in relation to this Rule. I note that Mr Turner’s mount was finishing strongly and he made an error of judgement when angling out for a run.
Mr Turner accepted that his penalty would start after racing tomorrow as he had no declared rides at Palmerston North on November 12.
After taking into account all the above factors I consider an appropriate penalty is a 5 day suspension.
