The protest was upheld and J D SPUR was relegated form 4th to 5th placing. Consequent upon the relegation, the amended result for the race is as follows:
1st   4  Beau Brummell
2nd  8  Another Love
3rd  3  Dream Defence
4th  7  Mariposa
5th 12 J D Spur

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 1, Opihi Vineyard Juvenile Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against J D SPUR (J B Geddes), placed 4th by the judge, on the ground of “breaking from its gait just prior to the winning post.”

Mr J B Geddes was present at the hearing of the information and he indicated that he was representing the connections of J D SPUR at he protest hearing. He further indicated that he did not contest the protest.

Rule 870 provides as follows:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869 (8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Submissions for Decision:

Mr Ydgren showed a video replay of the final 200 metres of the race. He pointed out J D SPUR, driven by Mr Geddes, break from its gait approximately 15-20 metres from the finishing line and continue in a gallop to past the finishing line. The horse finished in 4th placing and was, clearly, lapped on by the 5th placed runner, MARIPOSA. There was some discussion as to whether it was also lapped on by the 6th placed runner, COMMANDER GALLEON. After a consideration of the video replay and the official photo finish of the race and, having regard to the judge’s official margin between 4th and 6th (1 length), the Committee was satisfied that it was not so lapped on.

Reasons for Decision:

The Committee was satisfied that J D SPUR was not in its correct gait when its nose reached the finishing line and that it was lapped on by the 5th placed runner, MARIPOSA, in its correct gait.
