Decision:

Accordingly after taking all the evidence into account NIPABRANDY is declared a non starter.  The other horse, BUSTER BLOODVESSEL, recovered after the slow start to finish second so under the provisions of the rule that placing remains in place.

Facts:

Following race 5, The Fell Engineering 1200, a request for a ruling was filed pursuant to rule 632.  This was to determine whether NIPABRANDY was denied a fair start due to the mechanical failure of the starting gate.

Rule 632 reads:  if in the opinion of the judicial committee a horse does not finish in the first 3 placings was prevented from taking an effective part in a race owing to the mechanical failure of starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord) the judicial committee may declare such a horse to be a non starter.

Submissions for Decision:

Mr Williamson explained to the committee that soon after the start the starter called him to say that 2 gates, being numbers 11 and 12, were both slow to open due to mechanical failure.  Mr Williamson demonstrated the video films which clearly showed the 2 gates in question were still partially closed when all the other gates were wide open.  He said the 2 horses affected were NIPABRANDY and BUSTER BLOODVESSEL.

Mr T Harrison, the starter, was then called to give evidence and he said there was no doubt that the 2 gates were slow to open due to mechanical failure. 

Mr Hutton, rider of NIPABRANDY, said his gate was definitely slow to open which affected his chances of positioning his mount where he wanted to.

Reasons for Decision:

After reviewing the video films the committee is clearly satisfied that the 2 gates in question were slow to open due to mechanical failure.  This materially prejudiced the chances of NIPABRANDY.
